People copyright to protect art, literature, music and computer digital creations and to prevent people from copying work. From a legal standpoint, it does not matter if the work is good or lousy. So long as it meets the standard for originality, it can be copyrighted. So when it comes to the CD copyright laws, they are not concerned with how good or bad you may sound. This means it is free or available for the public to use.If someone makes a copy of your original CD without your permission, they are in copyright violation. Substantive Work Any substantive work that says what you think or mean can be copyrighted. There is also what is considered a “moral right” that says the creator of a work has the right to get credit for the work.This means the work has to be in a permanent and enduring form. An idea cannot be copyrighted, no mater how good it is. So in the case of music, it needs to be written or printed. Then just because you have played it, does not necessarily mean the your singing is copyrighted. You will have to make a recorded version and the recording will have to be reproducible. Thus, the CD copyright laws. How Long is it Copyright Good For? The duration of a copyright lasts fifty years from the authors death. For corporate or anonymous works there is a finite life of the copyright.In the United States, any completed work is generally recognized as copyrighted even if there is no formal registration. However to legally enforce the right by pursuing any violation creates a hurdle that is better served if the work is registered. There are exceptions or fair use rights. This means users have some limited rights. For instance, in the field of medicine, it is within fair use law for doctors and nurses to make copies of various studies they may be using in their research. That right is to their own use and it does not allow them to make, disseminate or sell copies. Computers, digital media, programming technologies and file sharing has created new questions and resulted in new interpretations of the exceptions. This has also created new difficulties in the enforcement of copyrights and challenges to the meanings of copyright. If you did not give much concern for the copyright until now, once you become a publisher and start to produce and hopefully make money from your digital creations. There is increased support and lobbying from businesses who have economic dependence on copyrighted materials. Both legal and technological enforcement are increasingly being pursued. the exclusive legal right, given to an originator or an assignees to print, publish, perform,film, or record literary, artistic, or musical material, and to authorize others to do the same. Copyright Symbols © The © symbol is the standard copyright symbol. A copyright consists of three elements. - The © symbol
- followed by the year of first publication or creation of the durable, permanent or enduring form and
- followed by the owner of the copyright.
In Microsoft, the symbol can be created in the special symbols or on some systems, the default is a (c) which will turn into the copyright symbol. It will next be followed by a date and then the artist name or corporate copyright holder name. In Mac and on Pages, click edit (usually at the very top and on the left side, the third spot over from the apple. A drop down box should appear and at the bottom click on the words ‘special characters. ℗ The ℗ symbol, a P with a circle around it stands for phonogram. It is the copyright equivalent, notifying all that the phonogram or sound recording is copyright. The phonogram notice consists of three elements. - The ℗ symbol
- followed by the year of first publication of the sound recording and
- an identification of the copyright owner by name, abbreviation or other designation.
The exception for the third part is if the owner is the producer and if it is incorporated on the packaging. This is for protection against the unauthorized duplication of sound recordings. It also serves to distinguish the sound recording from the actual copyright for the music and for any other musical or audio work.
