When does work enter the public domain because it has an expired copyright? Below is the general overview of the copyright expiration times. It has been adapted to be in more common language. Even so, the laws are a bit confusing. After the the overview will be some basic information. Expired Copyright Created January 1, 1978 or Later Beginning of ProtectionWhen work is a completed creation in the actual material or form used by the artist, composer or writer. Ideas and concepts are not copyrightable. Length of Time of Protection Life of the artist / author + 70 years. Corporate: 120 years from authorship or 95 years after the date of publication, which ever is lesser. If the work involved collaboration or more than one author or creator, then the time starts from the death of the last author. If the work is pseudonymous, anonymous or for hire, the same term is applied. Published from 1964 -1977 Beginning of ProtectionIf published with copyright notice from creation or publication. Length of Time of Protection 28 years from creation /publication + 67 years. Created Before January 1, 1978 But Not Published Beginning of ProtectionJanuary 1, 1978 the effective date of the 1976 Act eliminating common law copyright Length of Time of Protection Life of the artist / creator + 70 years or December 31, 2002 whichever is greater. Created Before January 1, 1978 and Published Between 1-1-1978 and December 31,2002 Beginning of ProtectionJanuary 1, 1978 the effective date the 1976 Act eliminated common law copyright Length of Time of ProtectionLife + 70 years or December 31,2047 whichever is greater.
